Mediation is a negotiation process that is heavily reliant on assessment of positions through in-person discussion. The ability to assess the underlying human factors that may be influencing bargaining positions has made in-person the preferable mode and proven highly effective.
Zoom or online mediation can be effective, but the human element in the discussions is muted by the nature of technology.
In an effort to deliver the best quality in mediation services, two-party mediations may be conducted via Zoom or in-person.
Those mediations involving multiple parties with dissimilar interests must be conducted in the traditional in-person format.
